Age Limit

  • You must be at least 18 years of age in order to use The Leading Vibe Initiative form and (the "Service").
  • We highly advise that individuals aged 18 years or older, but under the age of 18, seek parental consent before sharing any personal information with anyone over the internet. Additionally, we encourage parents to educate their children about safe internet usage practices.

Consent

  • You hereby give your consent to the use of your image, video recording or likeness by Leading Vibe Initiative which includes but not limited to publicity, archival, promotional use amongst others.

Usage and Storage

  • You may access and display Content from this form on a computer screen or other devices, print individual pages on paper (excluding photocopying), and electronically store such pages on a disk (excluding any server or network-connected storage device) for your personal, non-commercial use. Commercial or unauthorized use, including but not limited to publication or any other form, is strictly prohibited. You commit to using the Service solely for your own non-commercial and lawful purposes. Failure to comply may result in civil and criminal liability.

Prohibited Use

Regardless of any other terms and conditions, you agree not to use the Services:

  • In a manner that violates any applicable local, national, or international law or regulation.
  • In any unlawful or fraudulent way or for any unlawful or fraudulent purpose.
  • To harm or attempt to harm minors in any way.
  • To transmit, knowingly receive, upload, submit, download, use, or re-use material that does not comply with our Acceptable Content Policy below.
  • To transmit unsolicited or unauthorized advertising, promotional material, or any form of similar solicitation (spam).
  • To knowingly transmit data, send, or upload materials containing viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or any other harmful programs or similar computer code designed to adversely affect computer software or hardware.
  • To copy, harvest, crawl, index, scrape, spider, mine, gather, extract, compile, obtain, aggregate, capture, access, store, or republish any Content, including but not limited to photos, images, text, music, audio, videos, podcasts, data, software, source or object code, algorithms, statistics, analysis, formulas, indexes, registries, repositories, or any other information available on or through the Service. This includes automated or manual processes, and for any purpose other than indexing Content for inclusion in a Search Engine. This also encompasses purposes related to data mining or the training or operation of any software or service that incorporates a large language model, foundation model, deep machine learning, generative artificial intelligence, or any other process commonly referred to as artificial intelligence.

Unauthorized Access: You may not attempt to access The Leading Vibe Initiative's servers by any means other than connecting via HTTP requests using a web browser. This includes attempting to use administrator passwords or impersonate an administrator while using the Service or through other means.

Service Interference: You agree not to disrupt, modify, or interfere with the Service, its associated software, hardware, or servers in any way. You also commit not to hinder or interfere with others' use of the Service.

Content by You

  • "UGC" refers to any Content that you or other users upload, submit, or make available on the Service.
  • You acknowledge that your communications on the Service are not private or confidential and may be viewed by our Team or Third-party sponsors on need-to-know basis.
  • Our Privacy Policy also applies to UGC.
  • We retain the right to review, edit, relocate, or delete any UGC at our sole discretion and without prior notice.
  • You are solely responsible for your UGC and may be held liable for UGC that you post. In this regard, you agree to comply with the following Acceptable Content Policy and not submit UGC that:
    • Is hateful, abusive, racist, discriminatory, sexually offensive, vulgar, defamatory, threatening to another user, promotes violence, infringes on third-party rights (such as copyright, trademark, trade secret, or any other personal or proprietary rights, or confidentiality), invades personal privacy or publicity rights otherwise objectionable.
    • Impersonates another person (including celebrities), falsely indicates that you are an employee or representative of The Leading Vibe Initiative or its partners.
    • You do not own or have the rights to submit or that is illegal.
    • Promotes any form of illegal activity.
    • Contains advertising, promotions, or commercial solicitations of any kind.
    • Imposes an unreasonable or disproportionately large load on the Service's infrastructure or otherwise adversely affects, restricts, or inhibits any other user from using and enjoying the Service.
    • Contains any virus, Trojan horse, worm, time bomb, cancelbot, or other similar harmful programming routine.
  • When you submit UGC, you grant us a non-exclusive, royalty-free, perpetual (i.e., lasting forever), worldwide, irrevocable license to exploit it in any manner or form and in any medium or forum, whether now known or hereafter devised, without notice, payment, or attribution of any kind to you or any third party. You also waive and agree not to assert any moral or similar rights you may have in your UGC.

Additional Rules

We reserve the right to post additional terms and conditions from time to time that apply to specific parts of the Service. These additional terms and conditions will be posted in the relevant sections of the Service and will be clearly identified. Your use of those parts of the Service constitutes your agreement to those additional terms and conditions.

Intellectual Property Rights

  • All Content and other materials on the Service are the property of either us or our third-party licensors and are protected by international copyright, trade dress, design, patent, trademark laws, international conventions, and other regulations safeguarding intellectual property and related proprietary rights. All rights to such content are reserved to us and our licensors.
  • You acknowledge that 'The Leading Vibe Initiative' and any other brands or logos belonging to us within the Service are The Leading Vibe Initiative trademarks (the "The Leading Vibe Initiative Trade Marks"), and you may not use them without obtaining written permission from The Leading Vibe Initiative.
  • Unauthorized copying of Content found on this Service may result in the revocation of your access to the Service and potential legal action.

Complaints

  • We hold a deep respect for the intellectual property and other rights of individuals, and we request our users to do the same. In suitable situations and at our discretion, we may terminate the access of users who infringe upon the rights of others.
  • Copyright: If you believe that your work has been copied and is accessible on the Service in a manner that constitutes copyright infringement, or if the Service contains links or references to another online location that contains material or activity infringing on your copyright, please get in touch with us.

Indemnification

  • You consent to indemnify The Leading Vibe Initiative and its licensors, vendors, suppliers, service providers, as well as their respective officers, directors, members, employees, sub-contractors, agents, and representatives. You agree to hold them harmless from any and all claims, actions, suits, liabilities, losses, damages, costs, and expenses (including legal fees) that may arise from your UGC, your unauthorized use of our Content, or your violation of these terms and conditions.

Disclaimer of Warranty and Limitation of Liability

  • To the maximum extent permissible under applicable law, you expressly acknowledge that your use of the Service is undertaken at your own risk. The Service is provided on an "as is" and "as available" basis for your utilization. Furthermore, to the extent allowed by applicable law, The Leading Vibe Initiative and its licensors, vendors, suppliers, service providers, along with their respective officers, directors, members, employees, sub-contractors, agents, and representatives, explicitly disclaim any and all warranties, whether express or implied. This includes, but is not limited to, warranties of accuracy, reliability, title, merchantability, non-infringement, fitness for a specific purpose, or any other warranty, condition, guarantee, or representation, whether communicated orally, in writing, or electronically. This disclaimer extends to the accuracy or completeness of any information contained therein or provided by the Service.
  • The Leading Vibe Initiative does not assert or guarantee uninterrupted access to the Service, nor does it assure the absence of failures, errors, omissions, loss of transmitted information, or virus transmission on the Service. We do not guarantee that you will be able to access or use the Service at your chosen times or locations or that we will have adequate capacity for the Service as a whole or in any specific geographic area.
  • In no event shall The Leading Vibe Initiative or its licensors, vendors, suppliers, service providers, or their respective officers, directors, members, employees, sub-contractors, agents, and representatives be held liable for direct, indirect, special, consequential, or punitive damages arising from your use of the Service or the internet or for any other claim related to your use of the Service. Termination

  • Any information you provide about yourself to us or information collected by us about you will be utilized by The Leading Vibe Initiative and third-party sponsors in accordance with our Privacy Policy.
